Note: Unfortunately, participation in the prize draw is only possible from Germany. Participants residing outside Germany must be excluded from the prize draw (possibly also retrospectively).
CONDITIONS FOR PARTICIPATION.
Participation in the prize draw is subject to acceptance of these conditions of participation. By participating, the participant declares that he/she accepts the conditions of participation.

The organiser of this prize draw is Daimler Truck AG, Fasanenweg 10, 70771 Leinfelden-Echterdingen, Germany.
2. Eligibility to participate
All persons who have reached the age of 18 and are resident in the Federal Republic of Germany are eligible to participate. Employees of Daimler Truck AG and its sales organisation as well as their relatives, suppliers and implementing agency employees are excluded from participation in the prize draw.
3. Participation
3.1 Effective participation in the prize draw is deemed to have taken place when the participant has completed and sent off the prize draw form. Participation is not possible in any other way.
3.2 Participation in the prize draw is free of charge and only possible once per person. Multiple entries are not permitted and will result in the participant being excluded.
4 Participation period
The prize draw begins on 14 November, 12:00 CET and ends on 6 December 2024, 23:59 CET.
5. Prize
5.1 The prizes each consist of an original Mercedes-Benz Econic model with body for waste disposal.
5.2 Distribution of the prize in cash and transfer of the prize to other persons is excluded.
6. draw and further procedure
6.1 The winners will be drawn at random from all correct answers submitted via the entry form.
6.2 The winner will be notified by email after the end of the draw and no later than 11 December 2024, 12:00 noon CET. If possible, the prizes will be sent out before the start of the Christmas holidays. In order to receive the prize, it is mandatory to provide full contact details (first name, surname, address, e-mail) in response to the prize notification.
6.3 If the winner does not reply by email by 18 December 2024, 09:00 CET, a new winner will be selected.
7. Exclusion from participation
7.1 In the event of manipulation or attempted manipulation, the participant will be excluded from participation in the prize draw. Any entrant who participates or attempts to participate in this promotion with the intention of interfering with the operation of the promotion in a manner which, in the reasonable opinion of Daimler Truck AG, is inconsistent with these terms and conditions or unfair to other entrants may, at the sole discretion of Daimler Truck AG, be excluded from participation in this prize draw.
7.2 Participants who make false statements or entries on behalf of other persons will be excluded from participation at the sole discretion of Daimler Truck AG. Entries by third parties, entries made by agents/interest groups and all activities that undermine this prize draw are not permitted.
7.3 Daimler Truck AG also reserves the right to exclude participants who comment on pornographic, sexist, racist, discriminatory, right-wing extremist, violence-glorifying, radicalising or similar content that offends common decency or commercial content under the prize post at its own discretion and to arrange for the comment to be deleted.
7.4 The decision of Daimler Truck AG regarding the exclusion of a participant is final and binding.
8. Authorisation to accept the prize
8.1 The winner is responsible for being authorised to accept the prize. The Organiser will not provide any compensation for non-acceptance of the prize and in this case is entitled, but not obliged, to nominate a new winner.
8.2 If the Organiser decides to nominate a new winner, this will be done in accordance with Section 6 of these Terms and Conditions of Participation.
9. Infringement of third party rights
If the participant infringes the rights of third parties by posting information, the participant shall indemnify Daimler Truck AG against all claims, including claims for damages, if Daimler Truck AG is held liable as a result of this infringement. In this case, the participant must reimburse Daimler Truck AG for all costs incurred as a result of the infringement of third-party rights, including the costs of legal defence. Further claims for damages remain unaffected by this.
10. Reservation of right of amendment and cancellation
10.1 Daimler Truck AG expressly reserves the right to amend or adapt these terms and conditions at any time with effect for the future.
10.2 Daimler Truck AG has the right to terminate or cancel the promotion at any time at its own discretion. Participants cannot derive any claims for fulfilment or damages from premature termination.
11. privacy policy
11.1 Daimler Truck AG, as the controller within the meaning of the General Data Protection Regulation (‘GDPR’), collects, processes and uses all personal data provided to Daimler Truck AG in the context of this prize draw solely for the purpose of organising the prize draw.
11.2 The participant's personal data will not be published and will not be passed on to third parties, with the exception of service companies based in Germany (‘processors’) that support the organisation of this prize draw.
11.3 The processing pursuant to sections 11.1 and 11.2 of these terms and conditions of participation is based on Art. 6 para. 1 lit. b GDPR.

11.6 Der Teilnehmer hat außerdem das Recht, eine Beschwerde bei einer Datenschutzaufsichtsbehörde oder dem Datenschutzbeauftragten einzureichen, wenn er der Ansicht ist, dass die Verarbeitung seiner personenbezogenen Daten gegen die DSGVO verstößt (Art. 77 DSGVO). 11.7 Im Falle eines Löschungsantrags vor Ende des Gewinnspiels ist dieser Löschungsantrag mit der Beendigung der Teilnahme am Gewinnspiel verbunden, wenn er eine weitere Teilnahme verhindert. In diesem Fall ist es nicht mehr möglich, zu gewinnen.
11.8 Im Übrigen werden die personenbezogenen Daten des Teilnehmers nach Beendigung des Gewinnspiels gelöscht.

12. Exclusion of liability
Except in cases of gross negligence or wilful misconduct, Daimler Truck AG shall not be liable for any damage, loss or impairment resulting from the participant's ability to participate in this promotion being restricted or prevented. Similarly, Daimler Truck AG is only liable in cases of gross negligence and wilful intent for damages, losses or impairments resulting from participation in this promotion, receipt or use of the prize. Liability for damages resulting from injury to life, limb, health or material contractual obligations and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.
13. Other regulations
13.1 Legal recourse is excluded.
13.2 The law of the Federal Republic of Germany shall apply exclusively.
13.3 The place of jurisdiction is Stuttgart.
13.4 The European Commission provides a platform for online dispute resolution (OS), which consumers can use for the out-of-court settlement of a dispute arising from online contracts with a company established in the EU. This can be found at ec.europa.eu/consumers/odr/.
13.5 Notice pursuant to Section 36 of the German Consumer Dispute Resolution Act (VSBG): Daimler will not participate in a dispute resolution procedure before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG) and is not obliged to do so.
13.6 Should individual provisions of these Terms and Conditions of Participation be wholly or partially invalid or contain a loophole, the other provisions shall remain unaffected. Ineffective or incomplete parts shall be maintained with an effective content that comes closest to the meaning of the ineffective content.
