Terms and conditions of participation.
Participation in the prize draw requires agreement to these terms and conditions. By entering, the participant declares that they accept these terms and conditions.
1. Organizer
1.1 The organizer of this prize draw is Daimler Truck AG, Mercedesstraße 120, 70327 Stuttgart.
2. Eligibility
All persons who are at least 18 years old and reside in Germany are eligible to participate. Employees of Daimler Truck AG and its sales organization, their family members, suppliers, and employees of agencies involved in implementation are excluded from participation. The minimum age for the factory tour is 14 years.
3. Participation
3.1 Valid participation in the prize draw occurs when the participant submits a Unimog photo via the official Fan Friday submission form (see item 6). Participation via other channels is not possible.
3.2 Participation is free of charge and only possible once per person. Multiple entries are not permitted and will result in exclusion from the draw.
4. Participation Period
The prize draw begins on 26 August 2025 at 09:31 a.m. CET and ends on 5 September 2025 at 10:00 a.m. CET.
5. Prize
5.1 The prizes consist of a total of eight tickets for a factory tour at Mercedes-Benz Special Trucks in Wörth in 2025. A participant can win a total of 2 tickets. Accordingly, 2 x 2 tickets will be raffled for participants on the social media platform Facebook, and 2 x 2 tickets for participants on Instagram. Reminder: the minimum age for participation in the factory tour is 14 years.
6. Draw and Further Process
6.1 The winners will be selected at random from all entries of Unimog photos submitted via the official Fan Friday form at https://special.mercedes-benz-trucks.com/en/unimog-fan-friday.html. The terms and conditions stated on the aforementioned website apply.
6.2 The winner will be notified via direct message after the end of the draw and no later than 6 September 2025 at 10:00 a.m. CET. To receive the prize, the winner must provide their complete contact details (first name, last name, address, email) in response to the notification.
6.3 If there is no response via email by 10 September 2025 at 09:00 a.m. CET, a new winner will be selected.
7. Exclusion from Participation
7.1 In cases of manipulation or attempted manipulation, the participant will be excluded from the prize draw. Any participant who takes part or attempts to take part in a way that, in Daimler Truck AG’s reasonable opinion, contradicts these terms and conditions or is unfair to other participants, may be excluded at Daimler Truck AG’s sole discretion.
7.2 Participants who provide false information or submit entries on behalf of others may also be excluded at Daimler Truck AG’s discretion. Submissions by third parties, representatives or interest groups as well as activities undermining the draw are not permitted.
7.3 Daimler Truck AG further reserves the right to exclude participants who post pornographic, sexist, racist, discriminatory, right-wing extremist, violent, radicalizing or otherwise inappropriate content or commercial content in response to the prize post, and to delete such content.
7.4 Daimler Truck AG’s decision regarding exclusion from participation is final and binding.
8. Eligibility to Claim
8.1 The winner is responsible for being eligible to claim the prize. The organizer will not provide any compensation if the prize is not claimed and may, but is not obliged to, select a new winner.
8.2 If the organizer decides to select a new winner, this will be done in accordance with item 6 of these terms and conditions.
9. Infringement of Third-Party Rights
If a participant violates third-party rights by submitting information, the participant shall indemnify Daimler Truck AG from all claims, including compensation, arising from such infringement. In such cases, the participant shall reimburse all resulting costs, including legal defense costs, to Daimler Truck AG. Additional damage claims remain unaffected.
10. Right to Amend or Cancel
10.1 Daimler Truck AG expressly reserves the right to amend or adapt these terms at any time with future effect.
10.2 Daimler Truck AG is entitled to terminate or cancel the promotion at any time at its own discretion. Participants shall not derive any claims for performance or compensation from early termination.
11. Privacy Policy
11.1 Daimler Truck AG collects, processes and uses the personal data provided by participants in the context of the prize draw solely for the purpose of carrying out the prize draw, as the data controller under the General Data Protection Regulation (“GDPR”).
11.2 The participant’s personal data will not be published or passed on to third parties, except to service providers located in Germany who support the implementation of the prize draw (“processors”).
11.3 Processing according to items 11.1 and 11.2 of these terms is based on Article 6(1)(b) GDPR.
11.4 In relation to the processing of their personal data, participants have the right to free access to the personal data stored by Daimler Truck AG and to rectification, erasure, and restriction or blocking of that data (Articles 15–18 GDPR), subject to legal requirements.
11.5 Participants may exercise the rights set out in item 11.4 by sending an email to dataprotection@daimler.com with the subject “Access to personal data”.
11.6 Participants also have the right to lodge a complaint with a data protection supervisory authority or the data protection officer if they believe that their data has been processed unlawfully (Article 77 GDPR). The data protection officer can be reached at: Group Data Protection Officer, Daimler AG, 70546 Stuttgart, dataprotection@daimler.com.
11.7 If a participant requests data deletion before the end of the prize draw and this deletion request prevents further participation, the participant's entry will be considered withdrawn. In this case, winning is no longer possible.
11.8 Otherwise, personal data will be deleted after the prize draw has been fully completed.
11.9 The participant is not obliged to provide personal data. However, participation in the prize draw is not possible without it.
12. Disclaimer
Except in cases of gross negligence or intent, Daimler Truck AG shall not be liable for damages, losses or impairments resulting from restrictions or exclusion of the participant’s ability to participate in this promotion. Daimler Truck AG shall also be liable for damages related to participation in this promotion or receipt or use of the prize only in cases of gross negligence or intent. Liability for damages resulting from injury to life, body, health or essential contractual obligations, and liability under the Product Liability Act, remains unaffected.
13. Miscellaneous
13.1 Legal recourse is excluded.
13.2 The laws of the Federal Republic of Germany apply exclusively.
13.3 Place of jurisdiction is Stuttgart.
13.4 The European Commission provides a platform for online dispute resolution (ODR), which consumers may use to settle disputes out of court with businesses established in the EU. It is available at ec.europa.eu/consumers/odr/.
13.5 Notice according to § 36 of the German Consumer Dispute Resolution Act (VSBG): Daimler will not participate in a dispute resolution procedure before a consumer arbitration board under the VSBG and is not obligated to do so.
13.6 If individual provisions of these terms and conditions are or become invalid or incomplete, the remaining provisions shall remain unaffected. Invalid or incomplete parts shall be replaced or supplemented by valid provisions that come as close as possible to the intended meaning.
